FAQ

Common Questions

Do I need the candidate’s permission?

Yes. Under the Fair Credit Reporting Act, an employer must give the candidate a clear written disclosure, in a document by itself, and get written authorization before ordering a background report for employment purposes.

Where does the driving record come from?

Driving records come from the motor vehicle agency in the state that issued the license. How far back a record goes and what it includes vary by state.

Should I also run a criminal check?

Many employers pair a driving record with county, statewide or national criminal searches for driving roles. Searches can be bundled at a lower combined rate.

What if I decide not to hire based on the report?

The FCRA requires a pre-adverse action notice with a copy of the report and a summary of rights, a reasonable waiting period, and then a final adverse action notice. The candidate can dispute inaccurate information with the reporting agency.
